1. Introduction and Acceptance

Welcome to GlennGPT, operated by Smultron Studio AB (Organization Number: 559437-9751). These Terms of Service ("Terms") govern your access to and use of our AI chat service at glenngpt.se (the "Service").

By creating an account or using the Service, you agree to these Terms. We may modify these Terms at any time by posting changes on this page. Continued use after changes constitutes acceptance.

2. Definitions

"Consumer" means an individual acting for purposes outside their trade, business, craft, or profession.
"Business User" means an individual or organization using the Service for commercial or professional purposes.
"Your Content" means information and data you input into the Service.
"AI-Generated Content" means output produced by AI models in response to your prompts.

3. Service Description

GlennGPT provides AI-powered chat services with Swedish data residency. All data is stored and processed in Sweden in compliance with GDPR. Certain non core features may require third party processing outside of Sweden, this is clearly stated in the service. The Service includes access to AI language models, conversation history, and various subscription tiers. Detailed features and pricing are available at our pricing page.

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect at any time.

4. Account Registration and Security

You must provide accurate information when creating an account. You are responsible for maintaining account confidentiality, all activities under your account, and notifying us of unauthorized use. You must be at least 18 years old to use the Service. Accounts are for individual use unless you have a business subscription with multi-user access.

5. Subscription Plans and Billing

5.1 Plans and Payment

Subscription fees are billed monthly or annually in Swedish Kronor (SEK) through our payment provider, Mollie. By subscribing, you authorize recurring charges. View current plans and pricing at our pricing page.

5.2 Withdrawal Rights for Consumers (Ångerrätt)

Consumer Right of Withdrawal

For Consumers: Under Swedish distance selling laws, you have the right to withdraw from your purchase within 14 days without giving any reason. The withdrawal period expires 14 days from the date of your subscription purchase.

To exercise your withdrawal right, inform us by email to support@aisamtal.se stating your intention to withdraw.

If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days from receiving your withdrawal notification, using the same payment method you used.

5.3 Cancellation

You may cancel your subscription anytime through account settings. Cancellation takes effect at the end of your current billing period. You retain access to paid features until the period ends.

5.4 Price Changes

We may modify subscription prices with 30 days' notice. Changes will not affect your current billing cycle but apply to subsequent renewals. You may cancel before the price change takes effect.

6. Acceptable Use Policy

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, abusive, or offensive content
  • Circumvent usage limits or security measures
  • Use automated systems without authorization
  • Resell or redistribute access without permission
  • Interfere with or disrupt the Service

Violation may result in immediate account suspension or termination without refund.

7. Intellectual Property Rights

All intellectual property in the Service remains the property of Smultron Studio AB or our licensors. You retain all rights to Your Content. By using the Service, you grant us a limited, non-exclusive license to process Your Content solely to provide the Service.

AI-Generated Content is provided for your use. However, we cannot guarantee it is unique or does not infringe third-party rights. You are responsible for reviewing AI-Generated Content before use.

8. Cloud AI Integrations

GlennGPT offers optional access to cloud AI models in Pro and Max plans. For detailed information about data processing, sub-processors, and privacy safeguards, see our Privacy Policy.

8.1 Platform-Provided Cloud AI Models

When you select cloud AI models provided through our platform interface:

  • Your contractual relationship is with GlennGPT, not the AI provider
  • We are responsible for sub-processor compliance with data protection requirements
  • Conversation data may be transferred outside the EU/EEA with appropriate safeguards

8.2 BYOK (Bring Your Own Key) Integrations

When you connect your own API keys to third-party AI providers:

  • You have a direct contractual relationship with the AI provider
  • GlennGPT acts only as a technical intermediary
  • You are responsible for API key security and usage costs
  • The provider's terms and privacy policy govern their processing

Business Users - BYOK Disclaimer

To the maximum extent permitted by law, we disclaim all liability for the AI provider's data practices, service availability, or compliance. You indemnify Smultron Studio AB from claims arising from your BYOK usage.

Consumer Protection - BYOK

When using BYOK, you enter a direct relationship with the AI provider. Review their terms before connecting your API key.

8.3 Prohibited Uses

You agree not to use cloud AI features to generate illegal content, impersonate others, create spam or malicious content, circumvent safety measures, or infringe intellectual property rights. Violations may result in account suspension.

8.4 Model Availability

We may modify available platform-provided models with reasonable notice. BYOK integrations depend on third-party API availability. Swedish-hosted models remain available on all subscription tiers.

9. Data Protection and Privacy

Your privacy is important to us. Our data practices are governed by our Privacy Policy and GDPR Compliance page. All data is stored and processed in Sweden, unless you actively choose to use optional features of the service that transmits data to third party for processing. Your conversations are not used to train AI models. We comply with GDPR and Swedish data protection laws.

10. Service Availability and Support

While we strive for high availability, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated when possible. Support is available at support@aisamtal.se. Response times may vary based on subscription tier, inquiry complexity, and support volume.

11. Limitation of Liability

Consumer Protection Notice

For Consumers: Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Gross negligence or willful misconduct
  • Any other liability that cannot be excluded under Swedish law

For Business Users and to the extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We do not warrant error-free, secure, or uninterrupted service
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid in the six months preceding the claim
  • We are not responsible for the accuracy or appropriateness of AI-Generated Content

12. Indemnification

Business Users Only

This indemnification clause applies only to Business Users, not to Consumers.

Business Users agree to indemnify, defend, and hold harmless Smultron Studio AB, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Service, violation of these Terms, violation of any third-party rights, or Your Content/use of AI-Generated Content.

13. Third-Party Services

The Service integrates with third-party providers for AI inference and payment processing. Your use of these services may be subject to their own terms. We are not responsible for third-party service performance or practices. See our Privacy Policy for details on our service providers.

14. Termination

We may suspend or terminate your account for violations of these Terms, fraudulent activity, inactivity, or non-payment. Upon termination, your access immediately ceases. We may delete account data after termination, subject to our data retention policies and legal obligations. Provisions that should survive termination (including limitations of liability, indemnification, and dispute resolution) will continue to apply.

15.1 Governing Law

These Terms are governed by Swedish law. For Consumers, this does not affect mandatory consumer protection rights under Swedish law.

15.2 Dispute Resolution Process

In case of disputes, parties agree to first attempt good-faith negotiation, then mediation if negotiation fails. Unresolved disputes shall be resolved in Swedish courts, with exclusive jurisdiction in Gothenburg District Court.

16. General Provisions

These Terms, together with our Privacy Policy and legal notices, constitute the entire agreement between you and Smultron Studio AB. If any provision is found invalid, remaining provisions continue in full force. No waiver of any term shall be deemed a continuing waiver. We are not liable for delays due to circumstances beyond our reasonable control (force majeure).

Assignment: You may not assign these Terms without our consent. We may assign these Terms to any affiliate, subsidiary, or successor entity, or in connection with a merger, acquisition, or sale of assets related to the Service. Any assignee will assume all obligations under these Terms, including our commitment to Swedish data residency and GDPR compliance as described in our Privacy Policy.
